1. Acceptance of Terms

By downloading, installing, or using any games or services provided by PolyClimb ("we", "our", or "us"), including but not limited to Poly Climb, EchoCube, and LumaTap (collectively, "the Games"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Games.

2. License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the Games on your personal mobile device solely for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Games
• Reverse engineer, decompile, or attempt to extract the source code
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Games for any commercial purpose without our written permission
• Use the Games in any unlawful manner or to violate any applicable laws

3. User Conduct

When using our Games, you agree to:

• Use the Games only for lawful purposes
• Not attempt to hack, cheat, or exploit bugs in the Games
• Not use automated tools, bots, or scripts to interact with the Games
• Not interfere with or disrupt the Games or servers
• Comply with all applicable local, state, national, and international laws

4. Intellectual Property Rights

All content, features, and functionality of the Games, including but not limited to graphics, design, code, text, audio, and trademarks, are owned by PolyClimb and are protected by copyright, trademark, and other intellectual property laws.

You may not use these marks without our prior written permission.

5. User-Generated Content

Currently, our Games do not support user-generated content, user accounts, or social features. All game data is stored locally on your device.

6. Third-Party Services

Our Games may display advertisements provided by third-party services, including Google AdMob. Your use of these third-party services is governed by their respective terms of service and privacy policies.

We are not responsible for the content, accuracy, or practices of third-party advertisers or services.

7. Disclaimers and Warranties

THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Games will be uninterrupted, error-free, or secure
• Defects will be corrected
• The Games are free of viruses or harmful components
• Results from using the Games will be accurate or reliable

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYCLIMB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Games
• Any unauthorized access to or use of your device
• Any bugs, viruses, or harmful code transmitted through the Games
• Any errors or omissions in any content
• Third-party advertisements or links

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE PAST SIX MONTHS (WHICH MAY BE ZERO FOR FREE GAMES).

9. Indemnification

You agree to indemnify, defend, and hold harmless PolyClimb and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Games
• Your violation of these Terms
• Your violation of any rights of another party
• Any misuse of the Games

10. Updates and Modifications

We reserve the right to modify, update, or discontinue the Games at any time without notice. We may also update these Terms from time to time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date.

Your continued use of the Games after changes constitutes acceptance of the updated Terms.

11. In-App Purchases

Currently, our Games are free to play and do not include in-app purchases. If we add in-app purchases in the future, additional terms will apply.

12. Age Restrictions

Our Games are rated for ages 4+ and are designed to be family-friendly. However, because our Games display third-party advertisements, parental supervision is recommended for children under 13.

By using our Games, you represent that you are at least 13 years old, or that you have parental/guardian consent if under 13.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle information when you use our Games.

• Game data is stored locally on your device only
• Third-party advertisers (AdMob) may collect data for advertising purposes

14. Termination

We reserve the right to terminate or suspend your access to the Games at any time, without notice, for any reason, including but not limited to violation of these Terms.

Upon termination, your license to use the Games will immediately cease. You must delete all copies of the Games from your devices.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Games shall be resolved in the courts located in the United States, and you consent to the exclusive jurisdiction of such courts.

16. Apple App Store Terms

For Games downloaded from the Apple App Store, the following additional terms apply:

• These Terms are between you and PolyClimb, not Apple
• Apple has no obligation to provide maintenance or support for the Games
• Apple is not responsible for addressing any claims relating to the Games
• In the event of any failure to conform to warranty, you may notify Apple for a refund, and Apple has no other warranty obligation
• Apple is not responsible for product liability claims, claims the Games fail to conform to legal requirements, or consumer protection claims
• You represent that you are not located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country
• Apple and its subsidiaries are third-party beneficiaries of these Terms

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PolyClimb regarding the use of the Games and supersede all prior agreements.
